REAAL Sweepstakes Terms & Conditions
OFFICIAL RULES:
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. Participation in this Sweepstakes constitutes your full and unconditional agreement to and acceptance of all terms and conditions of these Official Rules. Winners must supply valid USA mailing address (no P.O. Boxes accepted).
Sweepstakes Period. The REAAL DAD’s Sweepstakes (the “Sweepstakes”) begins on June 1, 2019 at 12:01am Eastern Time (“ET”), and ends on June 16, 2019 at 11:59pm ET (the “Sweepstakes Period”). A computer designated by the Sponsor will serve as the official timekeeping device.
Eligibility. Open and offered only to legal U.S. residents residing in one of the fifty United States or the District of Columbia throughout the Sweepstakes Period who are 18 years of age or older at time of entry and who have not won a sweepstakes sponsored or administered by Sponsor in the thirty (30) days immediately preceding the start of the Sweepstakes Period. Void outside of the United States, and where prohibited by law, and in Puerto Rico and the U.S. Virgin Islands. Employees of Sponsor and their immediate family members are prohibited from entry and ineligible to participate in the Sweepstakes. Immediate family members include relatives living at the same address as an employee.
How to Enter. To enter the Sweepstakes, during the Sweepstakes Period, visit Sponsor’s program page at www.dadbodinc.com/reaal. Online entries must be received during the Sweepstakes Period (for participation in final drawing). Sponsor assumes no responsibility or liability for lost, late, stolen, misdirected, mutilated, illegible, or incomplete entries.
Random Drawing. On or about June 20 Sponsor will hold a random drawing to select a winner from all eligible entries received. Total number of entries for the specified Sweepstakes is anticipated to be approximately 500. Chance of winning varies based on number of eligible participants. Winners will be notified via email using the email address provided to Sponsor and therefore must be able to be contacted through email in order to receive prize. It is the entrant’s responsibility to check “junk” email and Sponsor is not responsible for the entrant’s visibility of the email. Winners will also be announced on Sponsor’s Facebook and/or Instagram page(s). If the winner cannot be located or does not respond to claim the prize within five (5) days after notification, Sponsor will select an alternate winner via random drawing from all remaining eligible entries.
Prize. Five winners will receive a year’s supply of REAAL (12 jars). The approximate retail value of the prize is $660. No substitution, assignment, or transfer of a prize is permitted. In the event a prize is unavailable for any reason, Sponsor reserves the right, at its sole discretion, to substitute prize with one of equal or greater value. The value of a prize set forth above represents Sponsor’s good faith determination of the approximate retail value thereof, and the actual fair market value, as ultimately determined by Sponsor, is final and binding and cannot be challenged or appealed. In the event the stated approximate retail value of a prize is more than the actual fair market value of that prize, the difference will not be awarded in cash or otherwise. Prize winners are solely responsible for the reporting and payment of any applicable federal, state, and/or local taxes on the prize. Winners should allow 4-8 weeks after the conclusion of the Sweepstakes for delivery.
General Conditions. Entrant agrees to be bound by these Official Rules and the decision of the Sponsor, which shall be final. All prize winners may be required to sign before a notary public and return an affidavit of eligibility, prize acceptance, and/or liability and (where legally permissible) publicity release form within fourteen (14) days of receipt. In the event any of these executed forms are not returned to the Sponsor for any reason, potential prize winner is determined to be ineligible in accordance with these Official Rules, or Sponsor is unable for any reason to contact potential prize winner within seven (7) days, prize will be forfeited and awarded to an alternate potential prize winner in a random drawing from among all remaining eligible entries. Potential prize winners will not be deemed a “prize winner” until their submission of the notification materials is verified. In the event more winner notifications are issued, or more winning prize claims are received than the number of prizes set forth in these Official Rules due to computer, printing, human or other error or problem, a random drawing will take place from among all eligible entries for the prize at issue (or from among all persons so notified) to award the proper number of prizes as set forth in these Official Rules. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Under no circumstances will more than the number of prizes stated in these Official Rules will be awarded. Sponsor, agents and representatives of Sponsor, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled, delayed, or non-functioning computer, electronic, or wire transmissions; (iii) any condition caused by events beyond control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising from, in connection with, or as a result of participation in the Sweepstakes, or acceptance, use, or possession of any prize; or (v) any printing, typographical, or other errors in any material associated with the Sweepstakes. Sponsor reserves the right in its sole discretion to suspend or cancel the Sweepstakes at any time if a computer virus, bug, tampering, unauthorized intervention or interference, or other technical or security problem of any sort corrupts or disrupts the Sweepstakes’ administration, operation, security, or proper play. Sponsor reserves the right to cancel the Sweepstakes or change any element hereof, with or without notice, at any time, for any reason, including without limitation printing errors, web site errors, transmission errors, or other mistakes or problems in the production or operation of the Sweepstakes. Entrant further agrees that Sponsor, its agents and representatives, and promotion event entities are not responsible for and shall not be liable for any condition caused by events beyond the control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted. Sponsor also reserves the right to disqualify any person in its sole discretion tampering with the entry process, the operation of the Sweepstakes, or any aspect of the Sweepstakes, or who is otherwise in violation of these Official Rules. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.) Sponsor reserves the right to delete any Entry and disqualify from the Sweepstakes any entry that Sponsor deems to be offensive, lewd, obscene, slanderous, infringing, or otherwise inappropriate, in Sponsor’s sole discretion.
Release. By participating in the Sweepstakes, entrant agrees to release and hold Sponsor, Sponsor personnel, Sponsor’s affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors and Facebook harmless from any and all losses, damages, rights, claims, actions, liabilities, or expenses of any kind in connection with the Sweepstakes, or resulting from acceptance, possession, or use of any prize, including without limitation personal injury, death, and property damage, and claims based on publicity rights, defamations, or invasion of privacy. Further, entrant agrees to indemnify, defend, and hold harmless Sponsor, its affiliates, subsidiaries, and advertising, promotion, and fulfillment agencies against any and all losses, liabilities, damages, causes of action, judgments, awards, decrees, settlements, or expenses of any kind (including without limitation legal fees and court costs) arising from or in connection with or by reason of any activity that breaches these Official Rules.
Disputes. Entrant agrees that all legal actions related to this Sweepstakes or these Official Rules will be exclusively brought in the state or federal courts sitting in Palm Beach County, Florida, and governed by the laws of the State of Florida. Entrant hereby irrevocably and expressly consents to jurisdiction in the State of Florida for those purposes.
Publicity and User Generated Content. Sponsor will have all rights to copy, edit, broadcast, publish and use, in whole or in part, any entry in any manner without further compensation (except where prohibited by law). By participating in the Sweepstakes, each entrant hereby: (i) represents and warrants that entrant owns all right, title, and interest in and to entrant’s entry; (ii) represents and warrants that entrant’s written submission complies with Sponsor’s terms of use; (iii) irrevocably and unconditionally grants, assigns, and transfers all right, titles and interest to entrant’s entry to Sponsor, and agrees that such grant, assignment, and transfer conveys to Sponsor the right to use, reproduce, encode, store, edit, modify, copy, transmit, publish, broadcast, or otherwise use, re-use, or re-produce any information contained in the entry in any medium or format now or hereafter created, for any purpose without further remuneration and in Sponsor’s sole discretion; (iv) irrevocably and unconditionally agrees to the use by Sponsor of the entrant’s name, biographical data, video, voice, and/or likeness for the purpose of advertising, trade or promotion without further compensation, unless prohibited by law; (v) acknowledges that Sponsor may grant a license to others for any use permitted by these Official Rules; and (vi) waives and agrees to execute a written agreement waiving entrant’s moral right in the Entry, represents and warrants that entrant has the right to grant the rights herein and that the exercise of the rights by Sponsor will not violate any person’s rights, whether contractual or otherwise.
Privacy. Personal information collected from entrants during the Sweepstakes Period is subject to Sponsor’s privacy statement available at http://www.twinlab.com/content/isibrands-privacy-policy and, except as otherwise provided in these Official Rules, will be treated in accordance with the terms of that statement. Subject to an entrant’s decision to opt-out, by entering the Sweepstakes, each entrant understands that Sponsor and its advertising or promotion agencies may use entrant’s information for marketing purposes and to provide entrant with information about Sponsor's products, services and special offers.
Winner’s List. List of winners is available upon request by sending a written request along with a stamped, self-addressed envelope (VT residents may omit return postage) to: Twinlab Corporation, Attn: “Facebook Sweepstakes & Giveaways – June 1 – June 16, 2019”, 3133 Orchard Vista Drive SE, Grand Rapids, MI 49546. Requests must be received no later than the date the prize associated with a given Sweepstakes is to be awarded as described in the post.
Sponsor. The Sweepstakes is sponsored by Twinlab Corporation, 4800 T-Rex Ave, Suite 305, Boca Raton, FL 33431 (“Sponsor”).
This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram.
